Men At Work lose lawsuit over flute solo plagiarism

The band Men At Work will be paying out some monetary damages over the flute riff used in their '80s hit "Down Under." A court found the riff originated from an Australian children's song. The story:

At what point does a musical phrase become copyrightable? One note? Two notes? Twenty?
