I talked to Marty, and he is ecstatic about our willingness to help. He didn't know that other bar owners were having the same problem with the PLCB. He also didn't know about our community on Rockpage.
I think I remember someone citing a noise ordinance in ?? State College ?? that had a specific noise level in DB/M measured from the property line. Can somebody point me in the right direction?

The law in question is
What Marty needs to do is get buddy buddy with his local township and get them to pass sensible laws and then take over enforcement of those laws, a couple of friendly township supervisors should be able to handle the whole thing, in larger towns...good f%$#in luck but way out in the boonies, it shouldn't be too much of a problem.
The problem here is that nobody has been able to pull this off yet, it would great to see actually get done, cause what works in Marstellar could probably work in Cresson or Patton or even Bellwood, Altoona I think would be a bigger problem but if you can site precedent in the smaller townships first, you might have a shot.

There is however a recent loophole that allows the municipal government.i.e. township, city, whatever to assert control of this law at the local level, that's why State College doesn't have this problem cause the SCPD handles it via SC city ordinances that do have a specific Db limit but without specific written instructions from the township/city what ever it's handled by the PSP and the the above law applies.Title 5 Subchapter C Amusments and Entertainments

(a) A licensee may not use or permit to be used inside or outside of the licensed premises a loudspeaker or similar device whereby the sound of music or other entertainment, or the advertisement thereof, can be heard on the outside of the licensed premises.

You should also take a look at the legal work done here on rockpage under "The Law". It includes a lot of casework that Marty's lawyer might find useful (and save him a lot of research/billing time)

I believe this bar is a gold star supporter for ABATE as well. The place is really nice and the people are really friendly. Anyone who hasn't been there yet, should go and check them out. For real.
