The PDF of the actual cease and desist letter:

I understand Peter Gabriel has or is also issuing a C&D letter.

I love Rush. I listen to him nearly every day. It's fun to listen to a simple commentator who the entire Republican Party Politicians are afraid of. And what he thinks is what they have to follow in lock step.
It's a shame that the real republican people can't tell their Republican representatives to stand up to the guy. But then the Politicians have NO backbone.
Why isn't this thread in the political arena ?

As long as Rush Limbaugh is paying the fees to have it on his show, they can't.moxham123 wrote:Can Rush and Peter Gabriel Legally Order Limbaugh to Cease Using Their Songs?

Actually, there are several ways they CAN. They can claim it will hurt their branding (I know I always wondered why uber-liberal Cryssie Hynde allowed her work to be the theme song, and am always aghast when I hear Rush on his show) and either stop use or tie it up in court (or threaten to). They can call for negotiations through Harry Fox Agency for royalties. Most people just issue a C&D letter, and the threat of messy legal action does the rest. You are right, though, Frank... the US is a fair-use country per the Berne Convention, you don't need permission, but you'll pay if you use something, and often quite expensively.f.sciarrillo wrote:As long as Rush Limbaugh is paying the fees to have it on his show, they can't.moxham123 wrote:Can Rush and Peter Gabriel Legally Order Limbaugh to Cease Using Their Songs?

I was reading that since he technically is a DJ, and his show is on the radio, and he pays the fees to have the music played, there is nothing that they can do. It isn't like a tv station, which they can do something about that.songsmith wrote:Actually, there are several ways they CAN. How strange that so many worship and defend the rants of a college-droput, 4-times-married, fat-mouthed deejay who needs off-market Viagra and Dominican rent-boys.f.sciarrillo wrote: I was reading that since he technically is a DJ,
If you or I called someone a slut on nationwide media, we'd get WAY worse than El Rushbo is getting.
You know, if you're a capitalist, you can't really complain about it all. This is the free market in action. People don't like his product lately, and are complaining to the only people who have any control over him, using their buying-power as ammunition. I LOVE that people aren't using the conservative whipping-boy, "big government," to get him out, they're using the weight of their wallets. 99% > 1%
