Bike rally organizers file lawsuit

Post by The_Underground »

Altoona Mirror - Feb 12th

A lawsuit that would detour plans by the Jaffa Shine to sponsor a motorcycle rally this fall will be heard by a Blair County judge next month.

A hearing for an injunction against the Jaffa’s plans to sponsor the new event, Rumble Thru the Alleghenies, has been requested by Kenneth Knisley of Altoona, who says he helped start Roar in The Mountains, the motorcycle extravaganza held at the Jaffa the past two years.

The Jaffa decided recently to hold its own event rather than host Roar.

The hearing has been scheduled for March 24 before Blair County President Judge Jolene G. Kopriva.

It could come much sooner, however, if a criminal trial planned for early March does not take place because of a plea agreement or a continuance.

McKeesport attorney David J. Puzak appeared before Kopriva Monday morning to request the injunction on behalf of Knisley.

Knisley said he began planning for Roar in January 2005 to take advantage of an annual influx of motorcycle enthusiasts.

He said the event was developed to promote tourism and generate event-related business opportunities.

Bill Wilkinson, chairman of Rumble, said last week that people complained about Roar in 2006 and 2007 because of offensive language at a concert, the lack of vendors and the disorganization of the gathering at the Jaffa Shrine Facility.

As the new year dawned, the Jaffa decided to hold a similar gathering at its venue, while Knisley’s event is to be moved to Legion Park in Hollidaysburg. Both are scheduled for the weekend of Sept. 19.

The lawsuit filed Monday charges that the similarity in the names of the events ‘‘is not accidental’’ and contends that the Jaffa ‘‘is purposefully imitating [Knisley’s] trade name, designs, logos and other materials with the intention of producing confusion in the public mind.’’

The lawsuit also charges slander and libel because of defamatory statements against Roar.

Monetary damages are being requested.

Wilkinson said last week that he was not afraid of a potential lawsuit because Roar has nothing to stand on.

When learning of the lawsuit Monday, Wilkinson said he would have no comment until the situation is resolved by the courts.

This is bullshit and I can't see where The Jaffa has any chance.

This would be like Ron coming to your shows and collecting the money. Since we use rockpage to promote our bands, that means he owns your band.
Oh, and he can also rename your band and dictate what music you play.

makes ya wonder the exact reasons why the home and garden shows and the such stopped having their events at the shrine in favor of the convention center.

see that's the unfortunate thing... The Jaffa is a nice room... can you imagine if they started having concerts there again... This is all bull.. the only thing I fear is that the Jaffa is loaded.. (as it takes a LOT of money to be a mason/shriner) and I'm sure there are quite a few lawyers in the organization... Roar may be in for a big fight...

While you're on the Mirror page, click on the PDF of the injuction request. Very interesting... it's alleged that the Shriners basically stole Roar's vendor list, and is soliciting those people directly. There's your wonderful people who only want to help little children, right there.

How can we picket this event? I want to stand outside the Shrine with a sandwich board and tell everyone who enters what's really going on. Maybe a free show somewhere else in the days prior to Whine At The Shrine, every band in town and every TV camera, a little show of Solidarnosc-style solidarity among local muso's. Perhaps take a collection for Shriner's Hospital, and make sure the press knows it'll bypass local Shriners and go directly to the kids, not the Jaffa's beer fridge.
Apparently, they think they need to improve their building, that the building is the reason their events keep getting smaller and less successful... anyone who's ever dealt with them knows it's the members themselves who ruin it.--------->JMS

money probably goes to each of their own "parade cruisers'" each year rather than the kids. Every parade I see they are in a different go-kart whether it's a jeep or some sort of cadillac etc...

The Roar was the shiznit and one of the best local concerts ever regardless what this turns into..

This was the letter to the editor in the Altoona Mirror this morning. It is not posted on the Altoona Mirror web site.

Shriners in the Wrong

I think something is seriously wrong with the Jaffa Shriners way of thinking concerning Roar in the Mountains.
Being the host of the event for two years doesn’t give the Shriners the right to take over the event and change the name to Rumble thru the Alleghenies.
They blame the sponsors for allowing bad language and neighbors complaining about bad behavior and the event not being family-oriented.
It is my understanding that the main attractions were approved by the Jaffa.
I don’t know anybody who thinks Jackyl puts on a family show.
For that matter, I don’t think a biker rally should be called family-oriented.
You want a family-oriented event? Maybe you should consider a minivan fest or a sport utility vehicle summer thing.
It is my understanding that the original sponsors and promoters are planning to have Roar in the Mountains somewhere else this year.
Good. I’ll be there with my bike, and the Jaffa can have the scooter crowd.
One last thought: Shriners shouldn’t put the blame on their ex-partners for their desire to have the whole enchilada.

I spoke with 2 shriners over the weekend.

They didn't seem to be very happy with Mr. Wilkinson's actions.

I got the impression that this was more Bill Wilkinson's personal agenda than the Jaffa's.

Seems he's just (ab)using his power and using the Jaffa/shrine as his vehicle.

They did both say they did not agree with the family friendly BS either.

Update: Roar VS Whine

Post by The_Underground »

Here’s the latest news coming out of the Altoona Mirror about the Roar/Jaffa Lawsuit. The Jaffa is petitioning the courts to dismiss the injunction filed against them by Roar in the Mountains. And yet again local bands are under attack, being used by the Jaffa as justification for their unfair business practices. Please check out the story online and post your support for local music.

Bike rally director seeks injunction to stop second event

By Phil Ray, pray@altoonamirror.com
POSTED: February 28, 2008

HOLLIDAYSBURG — The Jaffa Shrine Facility has asked a Blair County judge to dismiss an injunction request filed by the director of the annual Roar in the Mountains motorcycle rally because it would illegally bar the organization from holding a similar event.

Blair County attorneys Walter F. Wall and Norman D. Callan stated the Jaffa’s point of view in court papers filed Tuesday afternoon.

Roar director Kenneth Knisley of Altoona RD is seeking an injunction to stop the Rumble Thru the Alleghenies rally.

Judge Jolene G. Kopriva will hear testimony March 27.

Knisley’s event, held at the Shrine in September 2006 and 2007, came under criticism for offensive language at a concert, a lack of vendors and general disorganization.

Jaffa officials decided not to host the Roar this year and instead hold its own event on the same weekend. Knisley is planning to move his rally to Legion Park in Hollidaysburg.

Knisley, through East McKeesport attorney David J. Puzak, is claiming that the Jaffa stole his idea and is benefiting from the groundwork he laid the past two years. He has asked the court to impose a permanent injunction to block Rumble.

Knisley claims the Jaffa is wrongfully imitating his event by essentially using his trade name and taking advantage of the business relations he established.

He said unless the court imposes an injunction, he will ‘‘lose substantial business opportunities,’’ as well as the goodwill and reputation he has built.

The Jaffa contends it has no legal duty or contract with Knisley concerning a rally for bikers and that Knisley is off base with his contention that Roar will be harmed by Rumble.

If the injunction is granted, it would mean the Jaffa would be barred from using its own property for a lawful business or trade event, legal papers state.

Attorneys for the Jaffa argue that restraining the right to compete ‘‘is contrary to public policy.’’ They also argue that Roar has no right to bar competing events on a particular weekend.

The attorneys want the court to dismiss Knisley’s legal complaint against the Jaffa and deny a temporary or permanent injunction.

It seems EVERYONE (at the Jaffa) is in charge and NO ONE is accountable. It's definitely a "listen to me, don't listen to him" policy resulting in a disorganized, incohesive group. An organization that not only lacks respect for each other but tarnishes the hard work of their own volunteers by allowing those few in the Jaffa Office to continually make bad decisions. Bad decisions that are later covered up by jumping in front of television cameras and newspaper journalists and shouting from the rooftops that “We are the Jaffa and we help children.” Yes, we understand that some of the events do help raise money for children’s organizations, but that doesn’t excuse the underhanded, sneaky business deals that go on behind closed doors.

OK I'm here to say on RECORD...the Jaffa is lying about the vulgar language the "neighbors and attendents" complained about. And i can prove it. I'm the drummer of one of the bands that played that day. If ANYONE would have noticed it...it would have been me. I was there the ENTIRE day. And us as a band took EXTRA attention to be sure our band didn't use any offensive language and it was practiced and drilled to be sure we didn't. The fact is it's all about money. The thing that ruins just about anything good for everyone. The Jaffa sees this as a chance to steal some thunder, and make some coin in the process. It's all about the $ sign to them and I have proof of that to. They were unhappy with the vary fact that the bands...which were paid NOTHING...were donated pizza and not buying it from the Jaffa. Talk about money-hungry and PETTY!!! I understand we're in a recession but isn't 45 minutes of music worth a couple cuts of pizza? C'mon now

Just in case anyone missed it, yesterday was the trial. We lost on a technicality. The judge saw none of our evidence and heard very little testimony. Although we feel like we have been kicked around and beat-up today, Roar in the Mountains will be fine. We have the support of some kickass people here at rockpage. On behalf of Roar in the Mountains, and if I may be so bold, the Underground TV we thank you! I know it may not seem like it but your support made and will continue to make a difference. So heres the new link for the latest at the Altoona Mirror, so check it and write something nice!
